General Terms and Conditions (CGT)

These General Terms and Conditions (“GTC”) apply to all orders of products and bookings of workshops or private events (“Events”) with Atelier Amélie (“Organizer”). By placing an order or booking an Event, the Client agrees to be bound by these GTC.
1. Scope & Definitions
- “Products” – tangible goods sold by Atelier Amélie.
- “Events” – workshops or private events organized by Atelier Amélie.
- “Client” – the person or legal entity placing an order or booking an Event.
- “Participant” – any person attending an Event.
- “Consumer” – a natural person acting for purposes outside their commercial or self-employed activity.
- “Entrepreneur” – a person acting in the course of their commercial or professional activity.
2. Product Orders (VAT-free, Bank Transfer Only)
2.1 Ordering & Contract Formation
- A contract is concluded when Atelier Amélie confirms the order in writing (email or invoice).
- Prices are shown in Euros (€) and are final; no VAT applies, unless stated otherwise.
2.2 Payment
- Payment is due upon order confirmation.
- Payment method: Bank transfer only. The Client will receive bank account details in the order confirmation or invoice.
- The order is considered paid once the full amount is credited to Atelier Amélie’s bank account.
2.3 Delivery
- Delivery times are estimates unless a fixed date is confirmed.
- Risk of loss or damage passes to the Client upon delivery.
2.4 Right of Withdrawal (Consumers Only)
- Consumers have a statutory right of withdrawal under §§ 355 BGB for products.
- Workshops and private events are excluded from the right of withdrawal, as they are services provided for a fixed date or period.
3. Workshops & Private Events
3.1 Booking & Payment
- Once the customer has confirmed the date and details of the Event in writing, the Event is considered confirmed, and the payment obligation becomes immediately due.
- Payment method: Bank transfer only.
- Payment of 100% of the total amount must be received by Atelier Amélie no later than two (2) weeks before the Event date.
- The Event will only take place if full payment has been received by this deadline. Failure by the customer to pay the full amount on time shall be considered a late cancellation, and the applicable cancellation fees outlined in section 3.2 shall apply.
3.2 Cancellation & Rescheduling
Workshops
- No refund is possible under any circumstances.
- Rescheduling is allowed if requested in writing at least 14 days before the workshop. The fee already paid will be applied to the new date.
Private Events
- Cancellation less than 14 days before the Event: 50% of the total fee is due.
- Cancellation less than 7 days before the Event: 100% of the total fee is due.
- No refund is possible under any circumstances.
- Rescheduling is possible if requested in writing at least 14 days before the Event. A rescheduling fee may apply.
Organizer Cancellation / Force Majeure
- If Atelier Amélie cancels due to unforeseen circumstances (illness, official restrictions, force majeure), clients may receive a full refund or a new Event date. No further liability applies.
3.3 Participant Obligations
- All participants must follow venue rules and the instructions of Atelier Amélie staff during workshops and private events.
- All participants are required to have valid personal liability insurance (Haftpflichtversicherung) covering accidents or damages that may occur during the workshop or private event.
- Atelier Amélie may take photos or videos for marketing purposes; participants may opt out by notifying Atelier Amélie in writing before the event.
4. Liability
- Liability is limited to gross negligence and intent.
- For ordinary negligence, liability is limited to essential contractual obligations (“wesentliche Vertragspflichten”) and foreseeable, typical damages.
- Liability for indirect or consequential damages is excluded, except in cases of bodily injury, life, or health.
5. Data Protection
- Personal data is processed in accordance with GDPR/DSGVO.
- Data is used solely for order fulfillment, Event administration, and communication with the Client.
- Clients and Participants have rights to access, correct, and delete their data.
6. Modification of Terms
- Atelier Amélie may update these GTC.
- Changes will not apply retroactively to existing bookings unless expressly agreed.
7. Governing Law & Jurisdiction
- German law applies exclusively.
- Place of jurisdiction for disputes is Berlin.
8. Severability Clause
- If any provision of these GTC is invalid, the remaining provisions remain fully effective.
